DOJ Inspector General Michael E. Horowitz’s Crossfire Hurricane review states that SSA 1 “conducted” the January 24, 2017 interview of Michael Flynn “in connection with the FBI’s investigation of Flynn,” and that SSA 1 compared Flynn’s “norms” from the August 2016 candidate briefing with Flynn’s conduct at that interview. Joe Pientka III’s own September 17, 2021 memorandum in support of his motion to dismiss in Page v. Comey states: “Mr. Pientka is referenced in the OIG Report as ‘SSA 1.’” Fox News (December 2019) reported that a review of Horowitz “leaves little doubt that the unnamed SSA is Joe Pientka,” and that Strzok had identified Pientka as the notetaker. That identification is reporting; the SSA 1 self-admission is his civil filing. The government’s May 7, 2020 motion to dismiss the Flynn information recounts that Flynn pleaded to a false-statement count from the January 24 interview and argues the interview lacked a legitimate investigative basis — a filing about Flynn’s case, not a conviction of Pientka. Flynn’s later plea history and the government’s dismissal motion are docket facts about Flynn.

Official act documented: OIG attributes the interview to SSA 1; Pientka’s motion locks the SSA 1 label to him. Not a personal criminal conviction. His MTD also says he rotated off the Crossfire Hurricane team on January 9, 2017 — before the interview date — which is consistent with conducting a Flynn-case interview after leaving the broader Crossfire Hurricane TDY roster. Do not invent a “friendly drop-by” quote from Comey unless you open a primary transcript.

Flynn information later dismissed on government motion (2020). Separate from inventing a Pientka conviction out of the interview.

A declassified FBI Electronic Communication titled “Document Brief to Republican Candidate for U.S. President,” dated August 30, 2016, lists Contact / Drafted By: Joe Pientka III, From: Washington Field, and Approved By including Kevin E. Clinesmith and Peter P. Strzok II. The EC states that on August 17, 2016, the writer provided a counterintelligence and security briefing to Donald J. Trump, Chris Christie, and Michael Flynn at the FBI New York Field Office, lasting about thirteen minutes, in support of ODNI briefings. The writer’s summary includes the line identifying himself: “My name is Joe Pientka and I’m a Supervisory Special Agent of a Foreign Counterintelligence Squad at the FBI’s Washington Field Office.” The OIG review found that SSA 1 was selected to provide the FBI portion of the briefing, in part because Flynn (a Crossfire Hurricane subject) would attend; that SSA 1 drafted an EC documenting the briefing and added it to the Crossfire Hurricane investigative file; and that no one at the Department or ODNI was informed the FBI was using the ODNI briefing for investigative purposes. The OIG concluded the FBI’s use of the briefing for investigative reasons “could potentially interfere with the expectation of trust and good faith among participants in strategic intelligence briefings.”

Primary EC names him. OIG findings address process and policy recommendations — not a criminal verdict against Pientka. Commentary that the briefing was “spying” is opinion (Claims / Commentary).

OIG recommended FBI policy on using defensive/transition briefings for investigative purposes. No criminal judgment against Pientka for the briefing located for this file.

The OIG review states that the supervisor of the Carter Page investigation, SSA 1, was responsible for confirming the Woods File; that SSA 1 and Case Agent 1 performed a second factual accuracy review together; and that on October 20, Case Agent 1 and SSA 1 signed the “FISA Verification Form” or “Woods Form.” Pientka’s Page MTD states he was involved only in the initial FISA application (October 2016), that plaintiff alleges he reviewed the Woods File for that initial application, and that he played no role in the three renewal applications after he left the Crossfire Hurricane team in January 2017. The Page second amended complaint alleges more — that he “signed an authorization to submit” the first FISA and that the Woods File was inaccurate. Those complaint sentences are plaintiff allegations. Do not treat them as a court finding that he “swore the FISA” unless a signature page is in hand. OIG found serious Woods / FISA accuracy problems in the broader review; separate criminal conduct by Kevin Clinesmith concerned a later renewal email — not collapsed into a Pientka crime finding here.

OIG published FISA/Woods findings. Clinesmith later pleaded to altering a CIA email on a renewal — separate actor. No Pientka criminal judgment on Woods located for this rebuild.

The OIG Crossfire Hurricane examination discusses “SSA 1” throughout as a supervisory special agent on the team — Woods duties, candidate briefing, Flynn interview comparison, CHS/UCE approval narrative, and related testimony. The public PDF does not type the surname Pientka. Pientka’s own motion to dismiss states he is the person referenced as SSA 1. Fox News and other outlets published the identification after the report. An inspector-general abbreviation is not a secret confession and not a jury verdict. It is the government’s anonymized label for a documented supervisory role.

Identity lock between OIG role and named agent via his civil filing. OIG findings about process errors remain OIG findings — not automatic personal crimes.

OIG report stands as published. No substitute for a criminal judgment against Pientka.

Carter Page sued Joe Pientka III among other FBI/DOJ defendants under FISA and Bivens theories related to the Page FISA warrants. Pientka’s motion to dismiss argues the claims are time-barred, fail to state FISA/Bivens claims as to him, would extend Bivens improperly, and that he is entitled to qualified immunity / FISA safe harbor. The motion’s factual background is useful for dates and the SSA 1 admission; its legal arguments are advocacy.
